1. INTRODUCTION
- This document (hereinafter referred to as the "Terms and Conditions") together with the documents referred to herein sets out the terms and conditions of use of the website www.mojkrajtakipiekny.com (hereinafter referred to as the "Website") and the terms and conditions of purchasing products through it.
- Please read these Terms and Conditions and the Privacy Policy carefully before using the Website. As a Consumer or a sole entrepreneur with consumer rights, the Customer must accept the Terms and Conditions before placing an order, and once accepted, the provisions of these Terms and Conditions are binding for the order in question.
- The Terms and Conditions are subject to change, however, the changes will not apply to the provisions of the Terms and Conditions accepted by the Customer for any orders already placed. It is very important to read the Terms and Conditions and Privacy Policy each time a new order is placed.

The cost of the call to customer service is the same as for a standard call, according to the price list of the relevant operator.
- The agreement for the sale of products through this Website shall hereinafter be referred to as the "Agreement."
2. INFORMATION ABOUT THE SELLER
The sale of products via this Website is carried out under the name Mój Kraj Taki Piękny (My Country So Beautiful) or, in short, MKTP, by Karolina Sielska-Głuchowska, conducting business activity under the name MKTP Karolina Sielska-Głuchowska, with its registered office in Karczew (05-480), ul. Jagodne 5, registered in the Central Register of Business Activity, NIP: 5322045011, Regon: 146481182, (hereinafter referred to as "MKTP").
3. USE OF THE WEBSITE AS PART OF ELECTRONIC SERVICES
- When using this Website and placing orders through it (hereinafter referred to as "Orders"), the Customer undertakes to:
- use the Website solely for the purpose of submitting legally binding inquiries and Orders;
- not providing illegal content
- respect intellectual property rights and not copy any content/photos from the Website;
- not placing false or fraudulent Orders;
- provide a true and accurate email address, mailing address, or other contact information as may be necessary to place an Order. Providing this information is voluntary, but refusal to provide us with all the required information will result in the inability to place an Order
- By placing an Order on the Website the Customer declares that they are of legal age and have full legal capacity (to enter into contracts).
- In order to use the Website www.mojkrajtakipiekny.com, the Customer needs a working web browser.
- The following services within the meaning of the Act on the provision of electronic services (hereinafter referred to as "Electronic Services") are provided free of charge to Customers via the Website www.mojkrajtakipiekny.com:
- registration of a Customer Account;
- enabling Customers to place Orders and conclude Contracts on the terms specified in these Terms and Conditions;
- enabling the viewing of content posted on the website www.mojkrajtakipiekny.com;
- use of the Shopping Cart function.
- User registration on the Website www.mojkrajtakipiekny.com gives access to the Account function. For this purpose, the Customer should provide a login and password necessary to access their account. The Customer's login is the email address provided by them. The password is a string of characters determined by the Customer. The Customer's password is not known to MKTP, and the Customer is obliged to keep it secret and protect it from unauthorized access by third parties. After registering the Account, an agreement for the provision of electronic services (hereinafter referred to as the "Service Agreement") is concluded between the Customer and MKTP. The Service Agreement is concluded upon receipt by the Customer of confirmation of the registration of the Customer's account sent by MKTP to the email address provided by the Customer during registration. The account is provided free of charge for an indefinite period. The Customer may, at any time and without giving any reason, delete the Account (resign from the Account) by informing us thereof, in particular by e-mail to the following address:biuro@mojkrajtakipiekny.com . It is not necessary to create an Account in order to place an Order via the Website.
- The use of the Shopping Cart begins when the Customer adds the first Product to the Shopping Cart. The Shopping Cart is provided free of charge and is single-use, and its function ends when an Order is placed through it or when the Customer decides to stop placing an Order through it earlier, at their discretion, but when using the Shopping Cart through a web browser, placing Products in the Shopping Cart does not guarantee their availability.
- Complaints related to the provision of Electronic Services may be submitted, for example, in electronic form via e-mail to the following address:biuro@mojkrajtakipiekny.com. It is recommended that the Customer include the following in the description of the complaint: (1) information and circumstances regarding the subject of the complaint, in particular the type and date of the irregularity; (2) the Customer's request, and (3) the contact details of the person submitting the complaint – this will facilitate and speed up the processing of the complaint by MKTP. The requirements specified in the previous sentence are only recommendations and do not affect the effectiveness of complaints submitted without the recommended description of the complaint.
- We will respond to complaints submitted by Consumers immediately, no later than within 14 days from the date of submission. We will respond to other complaints immediately, but no later than within 30 days from the date of submission.
- MKTP will inform Customers each time about the suspension or limitation of services by posting an appropriate message on the Website. The temporary suspension or limitation of Electronic Services does not affect the rights of Customers under applicable law, in particular the right to terminate the Service Agreement.
4. PRODUCT PROPERTIES
- The properties of the presented Product are described in the Product information and its description, which is available on the Website. The photos of the Products on the Website are for informational purposes only.
- The Products offered on the Website may be delivered within Poland and abroad, but in the event of withdrawal from the Agreement, the Products may only be collected from the Consumer within Poland.
- Shipments sent outside the European Union may require the payment of appropriate customs duties. The Customer is responsible for paying such fees and other formalities related to the Order. MKTP is only responsible for the conformity of the Product with the Agreement and for handing over the Order to the courier.
5. CONCLUSION OF THE SALES AGREEMENT: ORDER AND ITS EXECUTION
- The conclusion of a Sales Agreement via the Website between the Customer and MKTP (hereinafter referred to as the "Agreement") may take place after the Customer has placed an Order in accordance with the rules set out below.
- To place an Order the Customer must complete the entire online purchase procedure, i.e. add the selected Product to the Shopping Cart, select the delivery method, proceed to payment (choosing one of the offered methods), and click the "Order and pay" button. Orders are accepted exclusively via the website www.mojkrajtakipiekny.com.
- If the data provided is incomplete, MKTP will contact the Customer. If it is not possible to contact the Customer, MKTP has the right to cancel the order.
- If the Customer registers, they will receive an email confirming the registration of their Account. Purchases can also be made as a so-called guest (without registration). The Customer will then receive an automatic email from us confirming that we have received the Order ("Order Confirmation").
- After making the payment, the Customer will receive an automatic email confirming the payment. If the payment is not made immediately, 48 hours after placing the order, the Customer will receive an email reminding them to make the payment. After another 48 hours have passed without payment, i.e. when the Customer has not made the payment within 96 hours of placing the order, it will be automatically canceled. If, after placing the Order, the Customer realizes that there is an error in the order regarding the type or quantity of selected Products or other data, they should immediately contact us by email or phone (the "Contact" tab on the website www.mojkrajtakiepiekny.com).
- After confirmation of payment, the Order receives the status of completion. The Customer will then receive an email with the information: "Status: order being completed." Order fulfillment and preparation for shipment usually take 1 to 7 business days. MKTP reserves the right to refuse to fulfill an Order (e.g., if a given Product is out of stock and there is no other identical Product in stock).
- Once we have processed the Order and prepared it for shipment, we will send the Customer an email about the preparation of the Order and the shipping details ("Status: shipped").
- When we send and the Customer receives the Shipping Confirmation, an Agreement is concluded between us and the Customer.
- The Customer's Order is also recorded and stored by the system. Accounting documents confirming the Agreement made through our website are stored for a period of 5 years.
- Promotions valid on the www.mojkrajtakipiekny.com website cannot be combined, unless the terms of the promotion clearly state otherwise. Vouchers are also not subject to promotions.
6. DELIVERY
- MKTP will deliver the Product(s) in accordance with the information contained in the email: "Status: shipped" within the approximate time frame indicated when selecting the delivery type.
- For the purposes of these Terms and Conditions, delivery shall be deemed to have been "completed" or the Order is "delivered" when the Customer or a third party designated by them actually takes possession of the Product, which will be confirmed by a signature on the receipt of the ordered Products at the agreed delivery address. Before acknowledging receipt of the shipment, the Customer is obliged to check that the packaging has not been damaged in transit.
- The Customer may choose the delivery method when placing the Order. Available carriers are visible when placing the order.
- Free delivery is available in Poland for orders with a minimum value of PLN 300, in European Union countries for orders with a minimum value of PLN 700, and for orders over PLN 1,000, delivery is free worldwide.
- Saturday delivery is possible depending on the availability of services from the given carrier.
- Upon delivery, the Customer assumes responsibility for the risk associated with the product. The Customer takes full possession of the products upon delivery.
7. INABILITY TO DELIVER TO THE CUSTOMER
- If the Customer is late in collecting the Order, we will grant them an additional period for collection. If it is impossible to deliver the Order within this additional period, we have the right to cancel the Order (withdraw from the Agreement), and the Agreement will be terminated. In this case, all funds paid under the Agreement will be refunded within 14 days.
- If the shipment is not collected due to the Customer's fault, the Customer must bear the direct shipping costs, which we will deduct when refunding the funds.
8. PRICE AND PAYMENT
- The prices listed on the website include VAT. However, the prices do not include shipping costs, which we add at the end to the price to be paid by the Customer.
- The total value of the Order includes the price of the Product and shipping costs. The Customer is informed about the total price of the Product (including taxes) that is the subject of the Order, as well as the delivery costs (including transport, delivery, and postal service fees) when placing the Order, including when the Customer expresses their willingness to be bound by the Agreement.
- Prices are subject to change at any time. However, price changes do not apply to Orders that have already been placed.
- The Customer may pay the price in the following ways:
- Paypal,
- Przelewy24,
- za pobraniem.
- The Customer should make the payment within 4 business days. This does not apply to cash on delivery payments. In exceptional situations, e.g. when there are only a few items left of a given Product, payment may be required within a shorter period of 24 hours, of which the customer will be informed when placing the Order
- The Customer may receive a receipt or VAT invoice if they make a purchase as an entrepreneur for purposes related to their business activity.
- If the Customer chooses to pay cash on delivery, they will be required to make the payment upon receipt of the Order. Failure to make payment will result in the inability to collect the shipment. Refusal or failure to collect the Order, despite the setting of an additional appropriate deadline, entitles MKTP to withdraw from the Agreement. The Customer may also cancel the Order within the specified time limit without incurring any consequences, which does not affect their right to withdraw from the agreement.
9. NON-COMPLIANCE OF THE PRODUCT WITH THE AGREEMENT
Non-compliance of Product with the Agreement under the Consumer Rights Act
- MKTP undertakes to deliver a Product in accordance with the Sales Agreement. The Product is in accordance with the Agreement if in particular the following elements are in accordance with it:
- description, type, quantity, quality, completeness, functionality,
- suitability for a specific purpose for which it is needed by the user, which the user notified MKTP of at the latest at the time of conclusion of the Agreement and which MKTP accepted. In addition, the Product is in conformity with the Agreement when:
- it is fit for the purpose for which products of this type are normally used, taking into account the applicable laws, technical standards, or good practices,
- it is in such quantity and has such properties (including durability and safety) as are typical for a product of this type and which can be reasonably expected, taking into account the nature of the product and our public assurances, in particular those made in advertising or on the label.
- MKTP shall not be liable for the Product's lack of conformity with the Agreement in respect of points 3) and 4) above if, at the latest at the time of conclusion of the Sales Agreement, the Consumer was expressly informed that a specific feature of the Product deviates from the above requirements of conformity with the Agreement and expressly and separately accepted the lack of a specific feature of the Product.
- If the Product sold is not in conformity with the concluded Sales Agreement, MKTP shall be liable to the Customer who is a Consumer or an entrepreneur with consumer rights and shall consider complaints in this respect on the basis of the provisions of the Consumer Rights Act concerning non-conformity of productwith the agreement (Article 43a et seq. of the Consumer Rights Act).
- In the event of non-compliance of the Product with the Agreement, the Customer referred to in section 1 above may request repair or replacement of the Product. If it is impossible to bring the Product into compliance with the Agreement in the manner chosen by the Customer or would require excessive costs for MKTP, MKTP has the right to:
- replace the Product when the Customer has requested repair, or
- repair the Product when the Customer has requested replacement.
- If repair and replacement are impossible or would involve excessive costs for MKTP, MKTP may refuse to bring the Product into conformity with the Sales Agreement, and the Customer may submit the request indicated in section 4 below. All circumstances of the case shall be taken into account when assessing whether the costs are excessive.
- In the cases indicated in section 4(a)-(b) above, the Customer shall make the Product subject to repair or replacement available to MKTP. MKTP shall repair or replace the Product within a reasonable time from the moment the Customer notified MKTP of the Product's noncompliance and without undue inconvenience to the Customer. MKTP shall bear the cost of repairing or replacing the Product.
- MKTP shall arrange for the collection of the Product at its own expense, for which purpose MKTP shall provide Customers with a free method of collecting the Product subject to complaint by courier.
- If the Product is found to be non-compliant with the Sales Agreement, the Customer referred to in paragraph 3 may demand a price reduction or a refund of the equivalent price due to withdrawal from the Agreement if:
- MKTP refused to bring the Product into conformity with the Agreement in accordance with paragraph 2 above;
- MKTP has not brought the Product into conformity with the Agreement in accordance with paragraph 3 above;
- the Product's non-compliance with the Agreement persists despite MKTP's attempts to bring the Product into compliance with the Agreement;
- the non-compliance of the Product with the Agreement is so significant that it justifies a price reduction or a refund of the price due to withdrawal from the Agreement without first using the remedies specified in section 2 above;
- it is clear from MKTP's statement or circumstances that it will not bring the Product into conformity with the Agreement within a reasonable time or without undue inconvenience to the Customer.
- The price reduction shall be proportional to the price of the Product, in the same ratio as the value of the Product in conformity with the Agreement would be to the value of the Product not in conformity with the Agreement. MKTP shall refund the amount due to the Customer as part of the price reduction immediately, no later than within 14 days of receiving the Customer's statement on the price reduction.
- The Customer referred to in paragraph 3 may not withdraw from the Agreement and demand a refund of the price for the Product if the non-compliance of the Product with the Agreement is insignificant. In the absence of separate statements, the non-compliance of the Product with the Sales Agreement shall be deemed significant.
- In the event of withdrawal from the Sales Agreement, the Customer shall immediately return the Product to MKTP at the expense of MKTP. MKTP shall refund the Customer the amount corresponding to the price of the Product immediately, no later than within 14 days of receiving the Product or proof of return of the Product.
- If the non-compliance of the Product with the Sales Agreement concerns only some of the Products delivered under the Sales Agreement, the Customer may withdraw from the Sales Agreement only in relation to those Products. An exception is a situation in which the Customer may withdraw from the Sales Agreement for all Products if it cannot be reasonably expected of the Customer to agree to keep only the Products that comply with the Sales Agreement.
- MKTP shall refund the amount to the Customer in the same manner as the Customer used for the original payment unless the Customer expressly agrees to a different method of refund which does not incur any costs for the Customer.
- MKTP shall be liable for any non-compliance of the Product with the Agreement which existed at the time of delivery of the Product and was disclosed within 2 (two) years from the date of delivery of the Product unless the Product expiration date is longer.
- MKTP shall not be liable for the Product's non-compliance with the Sales Agreement if the Customer referred to in section 3 above, at the latest at the time of concluding the Sales Agreement, received clear information that the purchased Product is defective (e.g., damaged, dirty, etc.) and accepted the lack of a specific feature of the Product.
- The Customer referred to in section 3 above may submit a complaint regarding the noncompliance of the Product with the Agreement (hereinafter referred to as the "Complaint") in any form. To facilitate the Complaint process, the Customer may use the Agreement form template (available on the MKTP website in the "RETURNS/EXCHANGES/COMPLAINTS" tab), but this is not mandatory. In this case, the completed form should be sent to the following email address: sklep@mojkrajtakipiekny.com. The Customer should describe the noncompliance of the Product with the Agreement and specify their request in relation to the noncompliance with the Agreement.
- A fiscal receipt is not necessary to complain about the Product, although it greatly facilitates the verification and Complaint process. Other ways to prove the purchase of the Product include, for example, printouts from a payment or credit card, or emails. MKTP does not make the acceptance of a Complaint conditional on the provision of a fiscal receipt.
- It is advisable to submit a Complaint immediately after noticing the non-compliance of the Product with the contract – for evidentiary reasons. The limitation period for claims in this respect is 6 years. MKTP will respond to the Complaint within 14 days of its receipt. If it fails to do so, it is deemed to have accepted it
10. STATUTORY RIGHT TO WITHDRAW FROM THE AGREEMENT
- A Consumer or entrepreneur with Consumer rights who has concluded a distanceform of Agreement may withdraw from the Agreement within 14 days without giving any reason and without incurring any costs other than those provided for by law or specified below (which constitutes the statutory right of withdrawal available to customers who are Consumers or entrepreneurs with consumer rights).
- To exercise the right to withdraw from the Agreement, the Consumer or entrepreneur with Consumer rights should notify us by email at: sklep@mojkrajtakipiekny.com of their withdrawal from the Agreement by way of a statement. Alternatively, the Consumer may send a letter by post to the following address: MKTP Karolina Sielska-Głuchowska, Karczew (05-480), ulica Jagodne 14, or inform MKTP by phone at: +48 538 576 010. It is not necessary to provide a reason for withdrawal.
- The Consumer or entrepreneur with Consumer rights may use the Model withdrawal form provided in Appendix 1 to these Terms and Conditions, but this is not mandatory.
- A Consumer or entrepreneur with Consumer rights does not have the right to withdraw from the Agreement if its subject matter is the delivery of one of the following products:
- Personalized/customized products tailored to the individual needs of the Consumer, non-prefabricated products, products manufactured according to the Consumer's specifications, or products designed to satisfy the individual needs of the Consumer;
- Audio or visual recordings or computer software delivered in sealed packaging, if the packaging has been opened after delivery;
- Goods in sealed packaging which cannot be returned after opening the packaging due to health protection or hygiene reasons if the packaging was opened after delivery.
- Effects of withdrawal from the Agreement: In the event of statutory withdrawal from the Agreement by the Consumer, we will refund all payments received from them, including shipping costs (up to the amount corresponding to the cheapest shipping option available at MKTP), using the same payment method that they chose when paying for the Product, unless they have expressly agreed to a different method of refund, which does not generate any additional costs for the Consumer.
- In the event of statutory withdrawal from the Agreement and selection of one of the refund methods we offer, the refund will be made without undue delay, and in any case no later than within 14 days from the date on which we were informed about the withdrawal from the Agreement. If the Consumer or entrepreneur with Consumer rights decides to return and send the Product(s) themselves (they did not choose the cheapest return method offered), we may withhold the refund until we receive the Product(s) or until proof of shipment is provided to us, whichever occurs first. If the Consumer or entrepreneur with Consumer rights decides to return and send the Product(s) on their own, the returned Products should be delivered to us (to the address: MKTP Karolina Sielska-Głuchowska, Karczew (05-480), ulica Jagodne 14) no later than 14 days from the date on which the Consumer or entrepreneur with Consumer rights informed us of their withdrawal from the Agreement. The deadline is met if the Consumer sends the products back before the expiry of 14 days.
- Except in the case of delivery in the cheapest manner indicated by MKTP, the Consumer must bear the direct costs of returning the Product(s).
- The Consumer or entrepreneur with Consumer rights is only responsible for any reduction in the value of the Product resulting from its use in a manner exceeding that necessary to determine its nature, characteristics, and functioning.
- In addition to the cheapest method of return – free of charge for the Consumer or entrepreneur with Consumer rights – they may return the Product(s):
- via a courier arranged by us: In the case of returning the Product(s) via a courier arranged by us, the Consumer or entrepreneur with Consumer rights shall bear the costs of the service. The cost of the courier service will be deducted from the amount due to the Consumer or entrepreneur with consumer rights for the return of the Product. The Consumer or entrepreneur with consumer rights may order a courier service in the "RETURNS/EXCHANGES/COMPLAINTS" tab or contact us using the online form or by phone at +48 538 576 010 to arrange for the product to be picked up from the Consumer's or entrepreneur with consumer rights' home;
- independently: The Consumer or entrepreneur with Consumer rights may contact us using the contact form or return the Product directly to the address indicated in the Model Withdrawal Form. The Consumer or entrepreneur with Consumer rights shall bear the direct costs of such return of the Products. Please note that if you choose cash on delivery as the method of returning the products, we have the right to charge the Consumer or entrepreneur with Consumer rights for any costs we incur in connection with this.
- After the statutory deadline for returning the purchased product (i.e., 14 days from the date of delivery of the purchased Product), the Consumer or entrepreneur with Consumer rights has the right to withdraw from the Agreement on the basis of the contractual right of withdrawal (below).
11. CONTRACTUAL RIGHT OF WITHDRAWAL
- In addition to the right of Consumers or entrepreneurs with Consumer rights to withdraw from the Agreement under the provisions of law referred to in Article 10. above, the Customer (regardless of whether they are a Consumer or not) has the right to withdraw from the Agreement within 30 days of the Confirmation of shipment of the purchased Product, provided that the effective withdrawal is conditional upon the actual return of the Product within that period.
- The right to withdraw from the Agreement applies only to Products that are returned in the same intact condition. We reserve the right to refuse to accept the return of Products sent or delivered after the return deadline (i.e., after 30 days from the Confirmation of shipment) or Products that are not in the same condition in which they were received. We will not issue a refund if the Product does not meet the above requirements.
- Effects of withdrawal from the Agreement: In the event of contractual withdrawal from the Agreement, we will refund the Customer for the Product using the same payment method that they chose when originally paying for the Product, unless they have expressly agreed to a different method of refund, which does not generate any additional costs for the Customer. The refund will be made without undue delay, in any case within 14 days from the date of receipt by MKTP of the returned Product from the User.
- The Customer must bear the costs of returning the Product to MKTP. Products should be returned as follows:
- via a courier arranged by us: If the Product(s) are returned via a courier arranged by us, the Customer shall bear the costs of the return. The cost of the courier service will be deducted from the amount due to the Customer for the return of the Product. The User may order a courier service in the "RETURNS/EXCHANGES/COMPLAINTS" tab or contact us using the online form or by phone at +48 538 576 010 to arrange for the product to be picked up from the Customer's home.
- The Customer shall not have the right to withdraw from the Agreement if its subject matter is the delivery of one of the following products:
- Personalized/customized products, non-prefabricated products, products manufactured according to the Customer's specifications, or products designed to meet the Customer's individual needs;
- Audio or visual recordings or computer software delivered in sealed packaging, if the packaging has been opened after delivery;
- Goods in sealed packaging which cannot be returned after opening the packaging due to health protection or hygiene reasons, if the packaging was opened after delivery.
- The Customer is responsible for any reduction in the value of the Product resulting from its use in a manner exceeding that necessary to ascertain the nature, characteristics, and functioning of the Product
- Right to withdraw from the Agreement and return in the case of orders from abroad: If the Customer has ordered products from outside Poland from another EU country via this Website, the above points apply with the proviso that the collection of the order by a courier ordered by MKTP can only be carried out within Poland. At the same time, we would like to inform you that under no circumstances are we obliged to pay the costs of re-shipping to destinations outside Poland.
12. RIGHT TO EXCHANGE THE PRODUCT
- The purchased Product may be exchanged within 14 days of receipt. The item being exchanged must not show any signs of use and must be in the same condition as when the Customer received it, with the tags still attached. The Customer must also provide proof of purchase (receipt, invoice, or bank payment confirmation).
- Exchange is possible if the item selected by the Customer (model, color, size) is available in stock. The exchange takes up to 14 days from the date we receive the shipment with the item to be exchanged.
- The Customer returns the items to be exchanged at their own expense and risk. We therefore recommend returning the product in its original packaging to protect it from damage.
- The exchange option is an independent right granted to the Customer by MKTP and does not in any way limit the statutory right of the Consumer or sole entrepreneur with Consumer rights to withdraw from the Agreement.
- In order to make an exchange, please fill out the form attached to the order (it can also be downloaded from the MKTP website in the "RETURNS/EXCHANGES/COMPLAINTS" tab) and follow the guidelines contained therein.
13. YOUR DATA AND PRIVACY
Information or personal data provided by the Customer will be processed in accordance with the Privacy Policy and applicable law, including Regulation (EU) 2016/679 of the European Parliament and of the Council (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (GDPR).
14. PROMOTIONS, DISCOUNT CODES, AND GIFTS FOR ORDERS
- MKTP publishes promotional offers and discount codes on the website www.mojkrajtakipiekny.com which are also communicated via social media channels. Promotions cannot be combined.
- If the Customer subscribes to the Newsletter, the discount code received cannot be combined with other discount codes available on the website www.mojkrajtakipiekny.com.
- MKTP has the right to add small gifts (gingerbread cookies) to Orders. In the event of a return of Products, the Customer is not obliged to return these small gifts.
- Additional products may also be offered as gifts, e.g., an MKTP bag, for orders above a certain amount. In the event of a return of the entire Order, the Customer is also obliged to return such additional products.
15. AVAILABILITY
- MKTP undertakes to ensure the accessibility of digital services in accordance with the Act of April 26, 2024, on ensuring the fulfillment of accessibility requirements for certain products and services by economic operators (hereinafter: "Accessibility Act") by referring to current harmonized standards and technical specifications.
- MKTP takes measures to ensure that the use of electronic services (including placing Orders, registering an Account, contacting the Online Store staff) is also possible for Customers with special needs.
- In case of difficulties in using the Online Store, the Customer may contact MKTP or file a complaint about the failure to ensure compliance with accessibility requirements by the services offered by MKTP in the following forms:

- We will consider the complaint within a maximum of 30 days from the date of its receipt. In particularly complex cases that prevent the complaint from being considered and a response from being provided within the time limit referred to in the first sentence, MKTP shall notify the User within that time limit of the reason for the delay and indicate a new time limit for considering the complaint and providing a response, not exceeding 60 days from the date of receipt of the complaint.
- If the deadline specified in paragraph 2 or 3 is not met, the complaint shall be deemed to have been considered in accordance with the complainant's request. MKTP shall comply with the complainant's request within a period not exceeding 6 months from the date of receipt of the complaint.
- If the complaint is not upheld, the User has the right to submit a notification regarding the Website's failure to comply with accessibility requirements to the President of the Management Board of the State Fund for Rehabilitation of Disabled Persons.
16. JURISDICTION
- Any disputes arising from the use of the Website or the Agreement or other related issues shall be subject to the exclusive jurisdiction of Polish courts.
- If, as a buyer, the Customer wishes to make a complaint in connection with the use of the Website www.mojkrajtakipiekny.com, they may send it to us by e-mail to sklep@mojkrajtakipiekny.com, in order to seek an out-of-court settlement of the dispute.
17. OUT-OF-COURT METHODS OF HANDLING COMPLAINTS AND CLAIMS AND RULES FOR ACCESS TO THESE PROCEDURES (ADR)
- The use of out-of-court methods of complaint handling and claim pursuit by a Consumer or an entrepreneur with Consumer rights is voluntary. Detailed information on the possibility for a Consumer or an entrepreneur with Consumer rights to use extrajudicial means of dealing with complaints and pursuing claims, as well as the rules of access to these procedures, is available at the offices and on the websites of district (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Provincial Inspectorates of Trade Inspection, and at the following websites of the Office of Competition and Consumer Protection:
- A Customer who is a Consumer or an entrepreneur with Consumer rights has the following examples of options for using out-of-court methods of handling complaints and pursuing claims:
- The Customer is entitled to refer the matter to a permanent consumer arbitration court operating at the Trade Inspection Authority;
- The customer is entitled to apply to the provincial inspector of the Trade Inspection with a request to initiate mediation or conciliation proceedings in the matter of out-of-court dispute resolution between the customer and MKTP;
- A Consumer or entrepreneur with Consumer rights may obtain free assistance in resolving a dispute between them and MKTP, also using the free assistance of the district (municipal) consumer ombudsman or a social organization whose statutory tasks include consumer protection (e.g., the Consumer Federation, the Association of Polish Consumers).
18. FINAL PROVISIONS
- The Regulations shall enter into force on September 30, 2025
- Agreements concluded by MKTP are concluded in Polish.
- The relevant provisions of the concluded Service Agreement shall be recorded, secured, and made available by sending an e-mail to the e-mail address provided by the Customer.
- The recording, securing, making available, and confirming to the Customer of the essential provisions of the concluded Sales Agreement shall be effected by sending the Customer an e-mail with confirmation of the placed Order (including the Order specification). The content of the Sales Agreement is additionally recorded and secured in the IT system of the Website. Proof of purchase will be provided via email or in paper form (in a package containing the Product).
- MKTP provides technical and organizational measures appropriate to the level of security risk of the functionalities or services provided under the Service Agreement. The use of Electronic Services involves typical risks associated with the transmission of data via the Internet, such as its dissemination, loss, or access by unauthorized persons.
- The content of the Terms and Conditions is available to Customers free of charge at the following URL https://mojkrajtakipiekny.com/pages/regulamin, where Customers can view and print it at any time.
- MKTP informs that the use of the Website via a web browser or contact with customer service may involve the need to incur the costs of connecting to the Internet (data transfer fee) or telephone connection costs, in accordance with the tariff package of the service provider used by the Customer.
- In matters not covered by these Terms and Conditions, the generally applicable provisions of Polish law shall apply, in particular: the Civil Code, the Consumer Rights Act, the Act on the provision of electronic services, and other relevant provisions of generally applicable law.
